GENERAL TERMS AND CONDITIONS AND GIVEAWAY RULES “With Moja babica from pregnancy to parenthood”.

1. Giveaway organizer: The organizer of the “With Moja babica from pregnancy to parenthood” giveaway is zavod MOJA BABICA, hereinafter referred to as the “organizer”.
2. Giveaway duration: The entire giveaway runs from the date of publication on January 10, 01. 2021, until the final draw on Saturday, January 30, 01. 2021. The prize of the week will be announced on Sunday. Participation for the announced prize will be possible until Friday of the same week at 9:00 PM. The winner will be announced the following day, Saturday, by 6:00 PM.

The giveaway is in no way associated with the social network Instagram (hereinafter Instagram) and is in no case sponsored, endorsed, or organized by Instagram. The recipient of the data provided by the participant is not Instagram, but the organizer. The organizer – and not Instagram – is solely responsible for the content of the giveaway. Instagram assumes no responsibility in connection with the giveaway.

3. Purpose of the giveaway: The purpose of the giveaway is to increase awareness of the importance of preparing for childbirth and parenthood, both in early pregnancy and in the last trimester, and to promote the organizer on social media.
4. Prizes: Each winner will receive the prize of the week in which they are drawn (Parenting School with a Difference (3 group workshops in person in Jan, Feb, Mar, or Apr); Physiological Changes in Pregnancy (access to online lecture) + individual consultation lasting up to 60 min; Information for a Successful Start to Breastfeeding + Manual Expression of Milk (access to online lectures). The total value of the prizes is (up to) EUR 260.00. Prizes cannot be exchanged for cash or any other prize. The prize cannot be transferred to a third party (it can only be received by the person tagged in the comment). The giveaway is completely non-profit.

Access to the online lecture will be available for 9 months; the giveaway for in-person workshops can be used during the scheduled group sessions in January, February, March, OR April.

Giveaway participants

The giveaway is subject to the restrictions set out in these giveaway rules.

5. Participation in the giveaway: A condition for participating in the giveaway is agreement with these rules and general terms of participation. By participating in the giveaway, the participant is deemed to agree with these rules and general terms.

Natural persons with permanent or temporary residence in the Republic of Slovenia, older than 15 years, can participate in the giveaway. Persons under 18 years of age can participate in the giveaway with the consent of parents or legal representatives. The participant must be a real person.

Persons employed by the giveaway organizer, their immediate family members (spouse or cohabiting partner or partner of a registered same-sex partnership, children or adopted children, and parents or adopters) may not participate in the giveaway and are not entitled to prizes. These individuals will be excluded from the giveaway by the organizer.

Participants can cancel their participation at any time until the end of the giveaway by sending a cancellation request to the email address nastja@mojababica.si. In this case, the participant is excluded from further participation in the giveaway, and the organizer will immediately ensure the deletion of their personal data.

6. Giveaway process: Participants take part in the giveaway on Instagram by:

• following the Instagram profile @mojababica – https://www.instagram.com/mojababica/,
• liking the giveaway post,
• on the @mojababica profile under the giveaway post, leave a comment tagging yourself or a friend who would benefit from the prize (and the friend agrees to the terms of participation). If you have multiple friends, tag each one in a separate comment.

All conditions must be met. An individual participant can take part in the giveaway multiple times but can only be selected once.

The purchase of any product is not a condition for participating in the giveaway.

7. Consent: By participating in the giveaway, you accept all the rules stated here, the general terms of participation, and the general terms at www.mojababica.si, which is also one of the conditions for participation. Other conditions are listed below.
8. Selection of winners: From those who participate in the giveaway in accordance with these rules, the organizer will select a winner on the Saturday after the post, based on a draw. An individual can only receive the prize for which they participated (the draw for a specific prize in a post is conducted among all individuals who participated under that post). The organizer reserves the right not to award the prize(s) based on the content of the submitted ideas. The organizer will conduct the selection of winners at the organizer’s premises. The selection will be documented with photos and shared on Instagram.
9. Notifying winners and claiming prizes: After the draw, the winner will be notified of the selection by a comment under the giveaway post on the organizer’s Instagram profile https://www.instagram.com/mojababica/ with a call to send a message with their email address to nastja@mojababica.si, where the organizer will send further instructions for claiming the prize. At the same time, a questionnaire required for the workshops will be sent to them via email. Winners expressly allow such publication of their first and last name or the name they use on the social network.

In the event that an individual winner does not respond to the organizer within 5 working days of the notification of receiving the prize, it will be considered that they are withdrawing their participation in the giveaway and at the same time waiving the right to the prize. The organizer does not assume any costs that may arise from claiming the prize.

To use the prizes, a computer/phone/tablet that supports the Microsoft Teams video conferencing system is required. For prizes containing online lectures, registration on vimeo.com is required.

The organizer reserves the right not to award the prize if:

• the winner does not meet the conditions for claiming the prize,
• it is found that the user participated in the giveaway in violation of the giveaway rules and terms,
• the winner does not provide their email address within the specified period,
• the winner does not claim the prize within 5 days of the draw.

Privacy and protection of personal data

The purpose of collecting, processing, storing, and using personal data is to conduct the giveaway. The organizer stores personal data (first and last name or the name used by the individual on social networks) in computer form. After the need for managing personal data ceases (prize claim) or based on a written cancellation by the individual, the data is immediately deleted. The organizer undertakes to protect the acquired personal data in accordance with the Personal Data Protection Act.

10. Submission of data

The giveaway is in no way associated with, sponsored, endorsed, or organized by Instagram. All data and information requested for participation in the giveaway will be provided only to the organizer. The organizer is solely responsible for the content of the giveaway.

11. Protection of personal data

By participating in the giveaway, the participant allows the organizer, as the controller of the personal data collection, to collect and process their personal data for the purposes of:

• conducting the giveaway in accordance with these general terms;
• notifying winners in accordance with these terms;
• publishing winners in accordance with these general terms;
• awarding prizes,
• publishing the submitted prizes in accordance with these terms.

The controller will protect the acquired data in accordance with the Personal Data Protection Act and in accordance with its internal acts adopted on the basis of the law. The controller will under no circumstances forward or disclose the acquired data to third parties. The participant has the right to access, transcribe, copy, supplement, correct, block, and delete personal data relating to them.

12. Liability

Participants take part in the giveaway at their own risk. The organizers and persons involved in the execution of the giveaway are not liable for any damage arising from the prizes. The organizer assumes no responsibility for any undesirable consequences that the participant and/or any third party might suffer as a result of participating in the giveaway. The organizer is also not responsible if the server is unavailable, unless this can be attributed to extremely negligent or intentional acts that the organizer is obliged to represent. Furthermore, the organizer is not responsible for any technical errors and disturbances over which it has no influence (such as network or power outages).

In the event of circumstances beyond the organizers’ control (force majeure), the organizers may cancel the giveaway. They must notify the participants in an appropriate manner. In such a case, they are not liable to the participants for any damage incurred.

The organizer’s decision on all questions regarding the giveaway or the application of the rules is final and applies to all participants. In the extraordinary case of early termination of the giveaway for reasons not on its part, the organizer reserves the right to award prizes among those who participated in the giveaway until the moment of termination or not to complete the giveaway without any obligations to the participants.

The giveaway organizer reserves the right to change these rules if legal, technical, or commercial reasons require it. Participants will be notified of any changes to these rules by a post on the website https://www.instagram.com/mojababica/.

Continued participation in the giveaway after the publication of any changes to the rules is considered acceptance and agreement with the changes.

Exclusion from the giveaway

13. Exclusion from the giveaway

In case of violation of these giveaway rules, the organizer reserves the right to exclude violators from the giveaway without prior warning. Persons who use illegal tools (e.g., hackertools, viruses, Trojans, etc.) or otherwise gain benefits through manipulation (e.g., one natural person with multiple profiles) will also be excluded. Persons participating on behalf of third parties (without their knowledge) can also be excluded from the giveaway, and participation through giveaway associations, automated services, and especially through professional giveaway services is also considered a violation.

In case of exclusion from the giveaway, prizes may be subsequently revoked from the winner, or prizes already delivered may be reclaimed from the winner. If the subsequently excluded winner no longer possesses the delivered prize, the organizer reserves the right to demand a cash amount from them in the value of the prize received.

Taxation of prizes

14. Taxation of prizes:Prizes in this giveaway are not subject to taxation.

Dispute resolution

15. Dispute resolution: For disputes arising in connection with this giveaway that cannot be resolved amicably, the competent court shall have jurisdiction.

By participating in the giveaway, participants confirm that they are familiar with the giveaway rules, accept them, and agree with them. In case of any dispute or ambiguity, these rules are considered primary in relation to any other publications, whether in printed, electronic, or any other form. The authentic interpretation of these rules is determined exclusively by the organizer and the technical provider.

The organizer will not consider late, incompletely filled, or incorrectly filled entries in the giveaway. The giveaway organizer’s decision on all questions regarding the giveaway is final and applies to all participants.
